We advise many families and individuals upon ways that they might preserve wealth within their own family to try and protect it against the effects of a relationship breakdown. We work with many family owned businesses, farmers and landed estates to ensure that they have appropriate structures in place, recognising the importance of protecting generational wealth.
The Family Court has wide discretion upon divorce and assets are not always protected for the party who brought them into the relationship. We are experienced in drafting Pre-Nuptial and Post-Nuptial Agreements, which can be an effective way of protecting wealth which is acquired prior to the marriage or by way of inheritance. We also work with our Estates Team to review the terms of Trusts and whether they may be affected by divorce. We give guidance upon the terms of Agreements if parents are transferring money or assets to their children. Unmarried couples should consider Cohabitation Agreements, particularly if purchasing property together.
We take a proactive approach by considering potential problems before they arise and work closely with you to find a workable solution for your family.
