Why do I need this training?
When it comes to winning, bidding for (and losing!) service contracts, a good understanding of the Transfer of Undertakings (Protection of Employment) Regulations 2006 (“TUPE”) is essential. There is no ‘one size fits all’ approach so it’s important to understand how the different parts of TUPE can impact in practice. Whilst the basic principles of TUPE are self-explanatory, there are numerous thorny issues that arise when trying to manage a service provision change such as whether there is a transfer in the first place, who is assigned to the transferring service, what terms and conditions have to be replicated and the implications when changes are proposed.
Training overview
For the first part of the session, you will be taken through the key requirements of TUPE and look at issues such as changes in a service and assignment of employees to a transferring contract. The second part of the session will involve “real life” case study questions to enable you to apply your knowledge and take part in group discussions.
What key topics will be covered?
The law relating to business transfers and the Transfer of Undertakings (Protection of Employment) Regulations 2006
- Service Provision Changes
- Assignment – who transfers?
- Fragmentation – is the service fundamentally different?
- Transfer of terms and conditions including Beckmann and Martin liabilities and union recognition
- Employee Liability Information
- Information and Consultation – dealing with measures
- Unfair dismissal and ETO reasons to dismiss
- Liability arising from TUPE transfers - protective awards, failure to provide ELI and unfair dismissal
