Love, Loss and Legalities: Navigating the Percival's Wealthy Turmoil
Mr and Mrs Percival, a wealthy couple, are facing several challenges in their relationship. Mr Percival, who is 70 years old, suffered a road traffic accident that has resulted in early stage memory loss and mood swings. Mrs Percival, 60 years old, has moved out of Bedding House (the family home) and is residing in their holiday home, contemplating divorce.
Despite the separation, Mr Percival continues to pay all the expenses for the holiday home and gives Mrs Percival £400 per month. Their 2015 mirror Wills are now in question after Mr Percival tore up his Will when he discovered Mrs Percival's departure. The Wills stated that their estate (worth circa £10 million) would be gifted to the survivor upon first death, and then equally to their children, Louise and Seth, upon the second death.
Seth is Mrs Percival's adult son from a previous marriage, he has some learning disabilities but lives independently in a flat nearby. Seth's eighteen year old daughter, Nina, lived with Mr and Mrs Percival until she recently moved into student accommodation, to start University. Now, Louise (the only biological daughter of Mr and Mrs Percival) has booked an appointment with us for her father to discuss creating a new Will and the potential financial consequences of Mrs Percival pursuing a divorce.
Join Howes Percival's Private Wealth experts for their upcoming webinar, where they will use the above case study to discuss various scenarios including: identifying undue influence; revocation and drafting of Wills; the importance of working collaboratively with other professionals; the definition of “child” in different contexts (with some surprises about who can claim to be "a child of the family"); financial claims upon divorce (including pensions, expert valuations and maintenance).
