The Presidents of the Employment Tribunals in England & Wales and Scotland have now announced the annual increase to the “Vento Bands”. As you may know, these are the guidelines which are used by Employment Tribunals when assessing how much compensation to award for “injury to feelings” in discrimination claims. The updated Vento Bands will apply to discrimination claims presented on or after 6 April 2025.
The updated bands are as follows:
Band
New 2025 Range
Previous 2024 Range
Lower band (for less serious cases)
£1,200 to £12,100
£1,200 to £11,700
Middle band (for cases which do not merit an award in the upper band)
£12,100 to £36,400
£11,700 to £35,200
Upper band (for the most serious cases)
£36,400 to £60,700
£35,200 to £58,700
Exceptional cases
Over £60,700
Over £58,700
The bands are reviewed on an annual basis, taking into account the changes to the Retail Prices Index measure of inflation.
Anna Bithrey comments: Where any discrimination claim is successful, the Employment Tribunal has discretion to make an award of compensation for injury to feelings. As illustrated by the updated Vento Bands, this can be substantial in serious cases, and will be in addition to any award for financial loss suffered by the employee (which is uncapped in discrimination claims). Employers could therefore be facing significant liabilities if employees bring successful discrimination claims. To help minimise exposure, it is vital to ensure that any policies on equality, diversity & inclusion and anti-harassment & bullying are up to date, and that staff are provided with adequate training which is regularly refreshed.
