As many of you will be aware, the Employment Tribunal uses the ‘Vento bands’ when it comes to assessing awards for injury to feelings in discrimination claims. These ‘bands’ give an indication as what award may be made. The Presidents of the Employment Tribunals in England & Wales and Scotland have recently issued guidance increasing these for claims presented on or after 6 April 2022 and are now as follows:
Lower band |
£990 - £9,900 |
Middle band |
£9,900 - £29,600 |
Upper band |
£29,600 - £49,300 |
Depending on the seriousness of the discrimination suffered by the Claimant the award will fall within either the lower, middle or upper band. Only in the most exceptional of cases will an award exceeding £49,300 be made.
