The Equality Act 2010 protects against the unfair treatment of individuals on the basis of their age, however, age discrimination remains one of the most common forms of unfair treatment in the workplace. ACAS has published new guidance on age discrimination to help employers, managers and HR professionals to deal with age discrimination at work.
Through the use of illustrative case studies, the guide offers advice on what steps can be taken to eliminate age discrimination in the workplace. It also helps users identify various forms age discrimination may take, be that by way of direct discrimination, indirect discrimination, harassment or victimisation, and explains how to prevent age discrimination through the various stages of the employment process.
The guidance highlights the legal requirements on employers in this area but also provides examples of circumstances where age discrimination may be lawful, which can often be a difficult issue for employers to evidence.
In addition to the guide, ACAS has also published two further documents; the top ten obligations for employers and the top ten age discrimination myths, with tips on how to avoid bias and preconceptions based on age.
Paula Bailey comments:
“This guidance will prove to be a useful reference for employers when dealing with tricky issues of age discrimination, in particular, discussions with employees about their plans for retirement.”
